Forensic Crash Investigation & Expert Witness Services

Court-appointed. Independently minded. Uniquely qualified across the road, the vehicle, and the driver.

When a driver is charged with dangerous driving causing death, or when a civil matter turns on the question of crash causality, the quality of the expert witness evidence can determine the outcome. The road environment, the vehicle, and the driver each contribute evidence in a serious crash. Standard investigation examines these elements — but typically in isolation, and often through a narrow lens: did the infrastructure meet its compliance obligations? Was the vehicle roadworthy? Did the driver deviate from the road rules? These are necessary questions. They are not sufficient ones.

TVL’s approach is different. By treating the crash as a system event — analysing the road environment, vehicle dynamics, and driver behaviour together, and paying particular attention to how they interact — TVL consistently identifies causal factors that isolated analysis misses.

A speed limit implementation that reconfigured driver expectation on a familiar route. A vehicle’s dynamic response that fell within specification but exceeded what the road geometry could accommodate. A sight line that met its design standard but failed the driver at the moment it mattered. These are the kinds of factors that surface when the evidence is read as a system rather than as a checklist.

These findings are not theoretical. They are drawn from actual criminal and civil proceedings before Australian courts, where TVL’s evidence has been accepted as demonstrating that system factors contributed to crash outcomes — with direct implications for the culpability of drivers charged.

What Makes TVL Different

Across The Whole System

The road environment, the vehicle, and the driver do not operate independently — they interact, and it is often at those interactions where crash causality is found. Johann Tay holds authoritative, degree-qualified expertise across all three domains, combined with a working knowledge of human factors and law. This means TVL can do something that narrower expert briefs cannot: analyse how a deceptive road geometry influenced driver perception, how a vehicle’s dynamic behaviour responded to that input, and how the driver’s actions — reasonable or otherwise — played out within that system. Each element examined in context, and in relation to the others.

A Unique Evidence Base

Court appointments provide access to the full police brief of evidence — scene documentation, 3D point cloud scans, skid and friction testing, vehicle data, and witness statements — assembled immediately after the crash by trained investigators with state-of-the-art equipment. TVL uses this evidence base to conduct an independent, impartial analysis that the road environment, the vehicle, and the driver’s actions are each examined on their merits.

Building A Body of Knowledge

Each case TVL examines contributes to a growing understanding of the non-obvious factors that influence crash causality — deceptive road environments, speed limit implementations that alter driver expectation, vehicle automation features that degrade response times. This body of knowledge has been presented at the Australasian Road Safety Conference and informs TVL’s broader road safety engineering practice.

Scope of Services

Matter Types

  • Dangerous driving causing death or serious injury
  • Culpable driving matters
  • Civil personal injury litigation
  • Insurance dispute resolution
  • Inquest proceedings
  • Road authority liability matters

Investigation Methodologies

  • Crash reconstruction and scene analysis
  • Vehicle safety and roadworthiness assessment
  • ADAS and Event Data Recorder (EDR) analysis
  • Road environment and human factors assessment
  • Driver perspective and sight distance analysis
  • Dashcam and CCTV footage analysis using forensic video tools
  • Photogrammetry and digital scene capture
  • Biomechanics of impact assessment

“ Crash investigation routinely examines the road, the vehicle, and the driver in isolation. TVL’s differentiator is weaving the evidence from all three together — including the interactions between them — to treat the crash as what it actually is: a system failure.”
